Acceptance of Terms

By accessing, browsing, or using MantoshShop (shop-kxbt.onrender.com or any associated domain), you unconditionally agree to be bound by these Terms of Use and all applicable Indian laws and regulations. If you do not agree, please discontinue use immediately.

⚖️ These Terms constitute a legally binding agreement between you and MantoshShop under the Indian Contract Act, 1872 and the Information Technology Act, 2000.

Eligibility & Account Rules

🎂You must be 18 years of age or older to create an account and make purchases
🔑You are solely responsible for maintaining confidentiality of your login credentials
📧You must provide accurate, complete, and current registration information
🚫One account per person — multiple accounts for abuse/fraud will result in permanent ban
📱You must have a valid Indian mobile number for order verification and OTP delivery

MantoshShop reserves the right to suspend or terminate any account without notice for violation of these terms, fraudulent activity, or abusive behavior toward sellers or support staff.

Buyer Responsibilities

📍Provide accurate delivery address — MantoshShop is not liable for failed delivery due to incorrect address
📞Be reachable on the registered phone number during delivery
✅Inspect the package before signing delivery confirmation (COD orders)
🚫Do not attempt chargebacks or payment reversals without contacting support first
🤝Do not misuse the return policy — serial returners may have return privileges revoked

Seller Terms

Sellers on MantoshShop agree to the following in addition to these general terms:

✅List only genuine, legally owned products with accurate descriptions
🚫No counterfeit, illegal, stolen, or prohibited goods
📦Ship orders within the committed time window (default: 2 business days)
💰MantoshShop charges a platform commission on each sale (rates as communicated)
⚖️Sellers are solely liable for GST compliance on their sales

🚫 Selling prohibited items (weapons, drugs, adult content, fake products) will result in immediate account termination and legal action under applicable Indian law.

Anti-Fraud & Prohibited Activities

The following activities are strictly prohibited and may result in account termination, legal action under Indian Penal Code (IPC), and reporting to cybercrime authorities:

❌Fraudulent transactions, stolen payment instruments, or identity theft
❌Creating fake reviews, ratings, or manipulating search results
❌Unauthorized scraping, crawling, or data mining of the platform
❌Attempting to hack, DDOS, or disrupt platform services
❌Money laundering through the marketplace
❌Circumventing payment systems to avoid platform fees

⚖️ Fraudulent activities will be reported to Indian Cybercrime Portal (cybercrime.gov.in) and law enforcement agencies.

Intellectual Property

All content on MantoshShop — including but not limited to logos, UI design, code, text, images, product listings, and data — is the exclusive intellectual property of MantoshShop and is protected under the Indian Copyright Act, 1957.

🚫Copying, reproducing, or distributing our content without written permission is prohibited
✅Sellers retain ownership of their product images and descriptions they upload

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from use of the platform shall first be attempted to be resolved through:

1️⃣Internal Resolution: Contact support@mantoshshop.com — we resolve most issues within 48 hours
2️⃣Consumer Forum: You may file a complaint on the National Consumer Helpline (1800-11-4000)
3️⃣Arbitration: Disputes above ₹1 Lakh shall be settled by arbitration as per the Arbitration and Conciliation Act, 1996
4️⃣Legal Action: Courts of India shall have exclusive jurisdiction
